Terms of Service

These terms are designed to be fair and straightforward. By using OmmiQ, you agree to these terms, which help us provide you with the best possible service.

By accessing and using OmmiQ, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

We grant you a personal, non-transferable, non-exclusive license to use OmmiQ for your personal or business productivity needs. This license is subject to these Terms of Service.

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities under your account.

You may not use OmmiQ to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Distribute malware or harmful content
• Attempt to gain unauthorized access to our systems

We strive to keep OmmiQ available 24/7, but we cannot guarantee uninterrupted service. We may need to perform maintenance or updates that temporarily affect availability.

OmmiQ offers optional paid extras. Purchases are one-time payments in Euro (EUR) and are processed by our payment provider Mollie B.V. We do not store your payment details on our servers.

OmmiQ is operated as a small business under §19 UStG (German small business regulation). No VAT is charged on purchases. Upon successful payment, you receive a confirmation email with an invoice number, and the invoice is retained in accordance with §147 of the German Fiscal Code (Abgabenordnung).

As a consumer resident in the European Union, you have a statutory right to withdraw from a purchase of digital content within 14 days under §312g and §355 of the German Civil Code (BGB).

Waiver for immediately accessible digital content: Extras are unlocked and made available to you immediately after payment. By completing your purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal under §356 Abs. 5 BGB once the digital content has been delivered. If you did not give this consent, please do not complete the purchase. For disputes or refund requests outside this framework, contact us at hello@ommiq.com and we will review your request in good faith.

OmmiQ is provided "as is" without warranties of any kind, express or implied, except as required by mandatory German and EU consumer protection law. To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing in these terms limits our liability for intent, gross negligence, injury to life, body, or health, or any other liability that cannot be excluded under German law.

You may terminate your account at any time. We may terminate or suspend your account if you violate these terms. Upon termination, your right to use OmmiQ will cease immediately, and any unlocked extras will become inaccessible along with your account. Invoice and payment records will be retained as required by law, as described in our Privacy Policy.

These terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of laws provisions and the UN Convention on the International Sale of Goods (CISG). Mandatory consumer protection rights under the law of your country of residence within the European Union remain unaffected.

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the application.
